Sham redundancy can't hide age discrimination

"younger, entrepreneurial profile" = age discrimination

Mr Achim Beck, a 42 year old banker, has won an age discrimination claim against the Canadian Imperial Bank of Commerce (CIBC) after the firm made him ‘redundant'.

Mr Beck was head of marketing at the bank and was dismissed alongside other members of the marketing team, but was replaced by a 38 year old.

An internal memo showed that the bank was actively seeking to recruit a replacement head with a "younger, entrepreneurial profile".

The employment tribunal held that CIBC had undertaken a ‘sham' redundancy process and did not accept CIBC's explanation that the use of the word "younger" simply meant less experienced.
